Terms of Use

Last Updated: August 19, 2026

Welcome to my website. By accessing or using this website, you agree to comply with and be bound by these Terms of Use. If you do not agree with these terms, please do not use this website.

These terms apply to visitors, prospective clients, and anyone using the information or services available through this website.

1. About This Website

This website is operated by Wathsala Gunarathne and provides information about web development services, including:

  • Website Development
  • Custom Web Applications
  • Back-End Development
  • API Development & Integration
  • Maintenance & Technical Support
  • Website Redesign & Optimization
  • WordPress Development

The information provided on this website is intended for general informational purposes and may be updated or changed without prior notice.

2. Use of the Website

You agree to use this website only for lawful purposes.

You must not:

  • Use the website for unlawful or fraudulent activities
  • Attempt to gain unauthorized access to the website or its systems
  • Interfere with the website’s functionality or security
  • Copy, reproduce, or redistribute website content without permission
  • Upload malicious code, viruses, or harmful material
  • Use the website to send spam or abusive communications
  • Attempt to access another person’s information or account

I reserve the right to restrict or terminate access to the website if these terms are violated.

3. Services

Information about services displayed on this website is provided for general guidance.

The exact scope, functionality, timeline, deliverables, and cost of a project will be agreed upon separately with each client.

A service description on this website does not automatically constitute a contractual offer or guarantee that a particular feature or service will be available for every project.

4. Project Quotations

Project quotations are prepared based on the requirements and information provided by the client.

A quotation may include:

  • Project scope
  • Required functionality
  • Estimated timeline
  • Development cost
  • Payment terms
  • Deliverables
  • Other project-specific conditions

A quotation is considered accepted only after the client confirms the project and the required initial payment has been received.

Changes to the project requirements after quotation approval may result in additional costs and changes to the estimated timeline.

5. Payment Terms

Unless otherwise agreed in writing:

A 50% non-refundable deposit is required before project work begins.

The remaining 50% is payable before final delivery, deployment, or website launch.

The initial deposit is non-refundable because it secures the project and covers planning, preparation, development time, resources, and the commitment allocated to the project.

Additional work outside the agreed project scope may require a separate quotation and payment.

6. Project Scope & Additional Work

The project will be developed according to the requirements agreed upon before development begins.

Requests that are substantially different from the original requirements may be considered additional work.

Additional work may include:

  • New features
  • Additional pages
  • New integrations
  • Major design changes
  • Additional functionality
  • Changes to previously approved requirements
  • Rebuilding completed sections

Any significant additional work will be discussed with the client before implementation.

7. Client Responsibilities

Clients are responsible for providing the information and resources required to complete their project.

This may include:

  • Website content
  • Images and media
  • Branding materials
  • Domain and hosting access
  • Third-party service credentials
  • API documentation
  • Product information
  • Business information
  • Required approvals and feedback

Delays in providing required information, content, access, or approvals may affect the project timeline.

Clients are responsible for ensuring that materials they provide do not infringe the rights of third parties.

8. Project Timeline

Estimated project timelines are based on the agreed scope and the timely provision of required content, access, feedback, and approvals.

A project may take longer than initially estimated if:

  • Requirements change
  • Additional functionality is requested
  • Client feedback is delayed
  • Required content or access is not provided
  • Third-party services cause delays
  • Technical issues outside my reasonable control occur

Estimated timelines are therefore not guaranteed completion dates unless specifically agreed otherwise in writing.

9. Revisions & Approvals

The number of revisions included in a project will depend on the agreed scope and quotation.

Clients are expected to review and provide feedback on designs, functionality, content, and other project elements within a reasonable timeframe.

Once a section or stage has been approved, significant changes to that approved work may be treated as additional work.

10. Website & Software Delivery

Final website files, application files, credentials, or other agreed deliverables will be provided according to the project arrangement.

Final delivery or deployment may be subject to settlement of the outstanding project balance.

Third-party licenses, premium plugins, themes, hosting, domains, APIs, subscriptions, and other external services are not included unless specifically stated in the project quotation.

11. Intellectual Property

Unless otherwise agreed in writing, ownership of the custom work specifically developed for a client will be transferred according to the agreed project terms after the project has been fully paid.

Third-party materials remain subject to their respective licenses and terms.

This may include:

  • WordPress
  • Premium themes
  • Plugins
  • Fonts
  • Stock images
  • APIs
  • Libraries
  • Frameworks
  • Other third-party software

I retain the right to use general development knowledge, techniques, coding practices, and non-confidential skills gained through a project.

12. Portfolio & Project Showcase

Unless otherwise agreed with the client, I may display completed projects in my portfolio for promotional and professional purposes.

This may include:

  • Website screenshots
  • Website links
  • Project descriptions
  • Company or business names
  • General information about the work completed

If a project is confidential or subject to a non-disclosure agreement, it will not be publicly displayed without appropriate permission.

13. Third-Party Services

Projects may depend on third-party services such as:

  • Hosting providers
  • Domain registrars
  • Payment gateways
  • Email services
  • APIs
  • WordPress plugins
  • Themes
  • External platforms
  • Shipping providers
  • Analytics services

I am not responsible for outages, policy changes, pricing changes, service interruptions, API changes, or failures caused by third-party providers.

Additional development required because of third-party changes may be charged separately.

14. Website Maintenance & Support

Maintenance and technical support are provided according to the agreed service or support arrangement.

Unless specifically included in a maintenance agreement, ongoing updates, troubleshooting, new features, security work, performance optimization, and additional development may be charged separately.

15. Website Security

Reasonable development practices are used to create secure and reliable websites and applications.

However, no website, application, server, plugin, or online system can be guaranteed to be completely secure.

Clients are responsible for maintaining secure hosting accounts, passwords, administrator accounts, and third-party services unless these responsibilities are specifically included in an agreed maintenance service.

16. Website Performance

I aim to develop websites with good performance and follow appropriate optimization practices.

However, website performance can be affected by factors outside development control, including:

  • Hosting quality
  • Server configuration
  • Third-party scripts
  • Plugins
  • External APIs
  • Content size
  • Network conditions
  • Client-side devices

Therefore, specific performance scores or rankings are not guaranteed unless explicitly agreed as part of the project.

17. Search Engine Optimization

Where SEO-friendly development is included, I may implement technical practices that provide a stronger foundation for search engine visibility.

However, search engine rankings and traffic cannot be guaranteed because search engines use their own algorithms and ranking systems.

18. Disclaimer

The information provided on this website is offered on an “as is” basis.

While reasonable efforts are made to keep information accurate and up to date, I do not guarantee that all website content will always be complete, accurate, current, or error-free.

Service availability, pricing, features, and information may change without prior notice.

19. Limitation of Liability

To the extent permitted by applicable law, I will not be responsible for indirect, incidental, special, consequential, or business losses resulting from the use of this website or services.

This may include losses relating to:

  • Business interruption
  • Loss of revenue
  • Loss of profits
  • Loss of data
  • Third-party service failures
  • Website downtime
  • Security incidents
  • Search engine ranking changes

Nothing in these terms is intended to exclude liability that cannot legally be excluded or limited under applicable law.

20. External Links

This website may contain links to third-party websites.

These links are provided for convenience or reference. I do not control and am not responsible for the content, security, availability, or privacy practices of external websites.

Your use of third-party websites is subject to their own terms and policies.

21. Changes to These Terms

I may update these Terms of Use from time to time to reflect changes to the website, services, business practices, or applicable requirements.

Updated terms will be published on this page with a revised Last Updated date.

Your continued use of the website after changes are published constitutes acceptance of the updated terms, to the extent permitted by applicable law.

22. Termination

I reserve the right to restrict or terminate access to this website where necessary, including where a user violates these Terms of Use or attempts to misuse the website.

Project-specific termination and cancellation conditions will be governed by the agreed terms between the client and myself.

23. Governing Law

These Terms of Use shall be interpreted and governed in accordance with the applicable laws and regulations of Sri Lanka, unless otherwise agreed in writing or required by applicable law.
